TC skidded off the road into a highway barrier after losing control of his vehicle due to pooling water on the surface of the road causing his vehicle to flip over and land in the midst of oncoming traffic. TC exited the vehicle and was then hit by a driver, Carlos Herrera, traveling westbound. The driver that struck TC was intoxicated at the time of the incident reducing his reaction time and causing him to hit TC. TC's injuries resulted in quadriplegia.

Marmol v. Adela Corporation

Marmol claimed there was negligence on the part of the Adela Corporation resulting in an incident in which Marmol was thrown from a dingy when it crashed into an anchored yacht suffering brain injury resulting in seizure-like episodes, a broken clavicle bone, and two bulging disks in his neck.

Settlement - $ 5,972,000 to Marmol

Fraud and ERISA
Jahn Estate v. Lyon, Disney

Robert Jahn was coerced by another Disney executive to sign over $2.8 million in benefits to prevent Disney from taking legal action against him for allegedly taking kickbacks while he was overseeing the production of movie previews just before he died in 1994 of AIDS. The federal jury on this case determined that there was not sufficient evidence to support the claims that Jahn had accepted payoffs and that Disney did not have the right to take away his benefits.

Settlement - All $ 2.8 million of Jahn's benefits were donated to Jahn's church.

Breach of Contract and Fraud
William Lyon Property Management Co. v. Markley

Markley was terminated when he refused to sell his interests in the Lyon Property Management Company's apartment development division so that the company could obtain additional financing to satisfy outstanding bank loans. The financial agreement pledged to give away 90% of the company's equity if they failed to meet the payment schedule as agreed, which was never disclosed to Markley, and was a breach of his ownership contract..

Settlement - $ 54.4 million to John Markley

Personal Injury
Jehu Soto v. Edwards Theater Circuit, Inc.

Mr. Soto was instructed to paint from the top of a 20 foot scaffolding that had been modified by stacking a moveable 10 foot scaffolding on top of it to increase the height to 30 feet inside a building. Soto was not wearing any safety harnesses or ropes while working at the top of the stacked scaffolding structure. When Soto climbed down from the top of the structure he fell and rolled off the edge of the planks separating the base scaffolding from the upper scaffolding dropping 20 feet to the floor below. Soto's sustained injuries included a basilar skull fracture, loss of his sense of taste and smell, memory loss, clavicle fracture, and fractures at T10-12.

Settlement: $ 1.815 million to Soto

Wrongful Termination
Sangermano v. Orange County Sanitation Districts

Mr. Sangermano was terminated for alleged sexual harassment following his report to Cal/OSHA regarding a cover-up of substandard safety conditions after a flash fire broke out at the Huntington Beach sewage treatment plant claiming the lives of two of his co-workers.

Wrongful Death
Families of Miller, Charles,& Patterson v. Orange County Sanitation District

Miller and Patterson died in a flash fire at the Huntington Beach Sanitation sewage treatment plant due to a failure to shut down an oxygen plant that filled the channel where they were replacing a valve with explosive gases. Richard Holm who was burned during the fire died of cancer several months later.

Settlement - Over $ 25 million to the surviving families of Miller, Charles, & Patterson

Desert Valley Medical Group, Inc. & Prem N. Reddy v. Mojave Medical Group, Inc., George O'Keefe, Victor Valley Community Hosital, Benjamin Nepomuceno, Lourdes Nepomuceno, Victor Valley Medical Group

Dr. Nepomuceno expressly directed the Victor Valley Hospital and ambulance service to engage in conspiratorial practices to monopolize the healthcare market in the high desert area, asserted defamatory statements about the hiring practices of the Desert Valley Medical Group with regards to pre-employment racial profiling, and Reddy suffered the economic loss of an account with Roadway.

Weyerhaeuser Mortgage Company v. California Federal Bank

California Federal Bank committed fraud after their subsidiary California Communities Inc. failing to fully pay approximately half of their initial loan of $24 million to Weyerhaeuser Mortgage Company. CalFed wrote two 'comfort letters' at the time of the loan agreeing to back the subsidiary's financial integrity. Additionally CCI provided financial documentation that was misleading with regard to the extent of the company's financial troubles.

Settlement - $ 31.5 million to Weyerhaeuser Mortgage Company
